341 MEETING OF THE CREDITORS FAQS

Normally, your 341 Meeting of Creditors will be held in the bankruptcy court of the district where your case was filed. You should receive a letter in the mail notifying you of your hearing date, which should also include the exact address, including the courtroom number. However, many bankruptcy courts are still only offering remote 341 Meetings of Creditors due to the coronavirus pandemic. If your hearing is remote, you will video conference with the judge and any creditors instead of going to court. Discuss with your attorney whether you will call in separately or meet in person and call in together.

Jury trials are extremely rare in bankruptcy proceedings. If you filed your petition voluntarily, a jury won’t be ordered unless you request one. A passport or other government-issued photo identification will work in lieu of your driver’s license. If you don’t have your social security card, you will need an original W-2 or another eligible document with your social security number. You should confirm that any substitute documentation qualifies with your attorney before attending the hearing.

You should have completed a credit counseling course before your case was filed, and included the course completion certificate with your filing. You will need to complete your second credit counseling course and file the completion certificate with the court no more than 60 days after your 341 Meeting of Creditors. Failure to complete your second credit counseling course within 60 days of your 341 hearing could result in your case being dismissed.

You don’t need to go out and buy a suit for this hearing. However, you should look presentable and professional. Dress as if you were going into the office or a similar setting. Although this is a relatively short and informal hearing, you should make it your top priority to attend your 341 Meeting of Creditors on time. Your case will likely be continued if you miss one 341 hearing. This will delay your bankruptcy discharge, which is when you can begin moving forward with a clean slate and rebuilding your credit. Your attorney may also charge an additional fee if they need to attend two hearings due to your nonattendance. Missing a subsequent hearing is more likely to result in your case being dismissed.
